Welcome to VLYNK (“we”, “us”, or “our”). By accessing or using our mobile app and services (the “Service”), you agree to be bound by these Terms of Service (“Terms”). Please read them carefully.

Eligibility

You must be at least 18 years old to use the Service. By using the Service, you confirm that you meet this age requirement and have the legal capacity to enter into these Terms. We do not knowingly collect personal information from children under 18, and minors are prohibited from using the Service without verifiable parental consent, which we currently do not support.

Account Registration and Security

To use certain features, you must create an account. You agree to provide accurate, current, and complete information and keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use or security breach

User Content and License

You may post, upload, or share content on our platform (“User Content”). You retain ownership of your User Content, but you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with the Service and our business operations. You agree not to post content that is unlawful, offensive, harmful, infringing, or otherwise prohibited in these Terms.

Prohibited Content and Conduct

You agree NOT to post, upload, or share any content or engage in any conduct that:

• Involves gambling, betting, or lottery services that are illegal or unauthorized.
• Promotes or facilitates the sale, distribution, or use of firearms, weapons, or explosives.
• Contains nudity, pornography, sexually explicit material, or adult content.
• Is violent, hateful, abusive, harassing, or discriminatory.
• Infringes on the intellectual property, privacy, or other rights of others.
• Is fraudulent, deceptive, or harmful.
• Violates any applicable laws or regulations.

Violation of these rules may result in immediate suspension or termination of your account and removal of the offending content without prior notice.

Purchases, Payments, and Refunds

Our Service allows you to purchase beauty products and related items. All purchases are subject to pricing, availability, and applicable laws. Payment transactions are processed securely through third-party providers. You agree to pay all fees associated with your purchases.

Refunds and Returns

• You may return eligible products within 7days of delivery for a refund or exchange, subject to product is unopened & in its original packaging.
• Certain items (e.g., opened cosmetics, personal care items) may be non-returnable for hygiene reasons.
• Refunds will be processed through the original payment method within 7 business days after we receive and inspect the returned product.
• For damaged or defective products, please contact us within 7 days of receipt to arrange a replacement or refund.

Intellectual Property

All content and materials on the Service, including logos, designs, text, images, and software, are owned by us or our licensors and protected by intellectual property laws. You agree not to copy, modify, distribute, or use any content without prior written permission.

Community Guidelines and Moderation

Our platform encourages positive, respectful interaction. We reserve the right to review, remove, or disable access to any User Content that violates these Terms or our Community Guidelines.

Users may report inappropriate content or behavior using the reporting tools in the app. Repeated violations may result in account suspension or termination.

Third-Party Services

The Service may include links to or integrations with third-party services (payment gateways, social media platforms, advertisers). We do not control these third parties and are not responsible for their content, policies, or practices. Your use of third-party services is subject to their terms and policies.

Marketing and Communications

By creating an account or providing your contact information, you consent to receive promotional messages, updates, and offers from us. You can opt out of marketing communications at any time by following the unsubscribe instructions included in our emails or contacting support.

Security

We implement reasonable security measures to protect your data. However, no method of transmission or storage is completely secure. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. We are not liable for any unauthorized access resulting from your negligence.

Disclaimers and Limitation of Liability

The Service is provided “as is” without warranties of any kind. We do not guarantee uninterrupted or error-free service.

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues arising from your use of the Service.

Our total liability, whether in contract, tort, or otherwise, shall not exceed the amount paid by you, if any, to use the Service.

Termination

We may suspend or terminate your account and access to the Service at our discretion, including for violation of these Terms or applicable laws, without prior notice.

Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via the app or other communication channels. Continued use of the Service after changes means you accept the updated Terms.

Dispute Resolution

Any disputes arising out of or related to these Terms shall be resolved through good faith negotiations. If unresolved, disputes will be submitted to binding arbitration under the rules of Indian Council of Arbitration (ICA)in Delhi, India. The language of arbitration will be English.

Force Majeure

We are not responsible for any failure or delay in performance due to causes beyond our reasonable control, including natural disasters, pandemics, strikes, or governmental actions.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

Entire Agreement

These Terms, together with the Privacy Policy and any other legal notices, constitute the entire agreement between you and us regarding the Service.

Governing Law

These Terms are governed by the laws of India. Any legal action shall be brought in the courts located in Raipur, India
